Starting A Practice

California’s Board of Behavioral Sciences is unusually clear that an associate cannot open an office of their own, and it says the same thing in plain words in each license FAQ.

Which Licenses Can Practice On Their Own In California

The California Board of Behavioral Sciences covers four licenses: Licensed Clinical Social Worker (LCSW), Licensed Marriage and Family Therapist (LMFT), Licensed Professional Clinical Counselor (LPCC) and Licensed Educational Psychologist (LEP). Psychologists are licensed by a separate agency, the California Board of Psychology.

California uses LPCC where other states use LPC or LMHC, so check the title your own license carries. The board licenses you, and each insurance company decides whether to credential you.

Associate And Intern Licenses In California

California calls the pre license stage an associate registration: Associate Marriage and Family Therapist, Associate Clinical Social Worker and Associate Professional Clinical Counselor. The board’s LMFT FAQ (revised 02/2025) answers the question directly: independent practice cannot begin until you are issued an LMFT license, and independent practice, including opening your own office, is considered unlicensed practice that is subject to disciplinary action. It adds that you may not receive payment directly from clients for services until you are licensed. The LCSW and LPCC FAQs say the same for those licenses.

The board’s ASW FAQ (revised 01/2026) adds that you must be a paid employee or a volunteer and may not bill clients directly. Associates can work in a private practice that a licensed professional owns, under conditions the board lists, but that is someone else’s practice.

Forming Your Business In California

California business filings go through the California Secretary of State. We couldn’t open the Secretary of State’s current fee page for this article, so check it on the day you file rather than relying on a number here.

On the structure question, the board’s FAQ describes a professional corporation as a type of nonexempt setting for associates, which tells you California treats professional corporations as a real structure for licensed therapists. Whether you need one, or whether another structure works for your license, is a legal question. Ask a California attorney before you file, because we don’t give legal advice.

California Medicaid

Medi-Cal is California’s Medicaid program. Provider enrollment runs through PAVE, the Provider Application and Validation for Enrollment portal at pave.dhcs.ca.gov, where you sign up for a user profile and start your Medi-Cal enrollment. The Department of Health Care Services keeps the guidance and bulletins on that site.

Medicare For LMFTs And Counselors

Since January 1, 2024, Medicare has paid marriage and family therapists and mental health counselors directly. CMS says that effective that date, MFTs and MHCs can bill Medicare independently for services furnished for the diagnosis and treatment of mental illnesses. CMS’s enrollment FAQ says to enroll through PECOS, the online system, or the paper CMS 855I application, and describes the requirements: a master’s or doctor’s degree that qualifies you for licensure, at least 2 years or 3,000 hours of post master’s degree clinical supervised experience, and a license or certification from the state where you practice.

We walk through the steps in our Medicare enrollment guide for counselors and MFTs.
